Scott Dudelson/Getty Images A federal court on Wednesday dismissed a class-action lawsuit against rapper Ja Rule that alleged he falsely promoted the doomed Fyre Festival. The rapper was a founder of the 2017 event, which promised a luxury experience but turned out to be a disaster. The suit was filed by festival attendees against both Ja Rule (whose real name is Jeffrey Atkins) and Fyre Festival Chief Marketing Officer Grant Margolin. It alleges that the men made false claims on social media about the festival’s amenities, performances and food. But a judge for the US District Court for the Southern District of New York ruled that Ja Rule and Margolin didn’t know the event would be a disaster.”Atkins and Margolin were participants in organizing or promoting a large-scale event,” the judge wrote. “There is no assertion that the Festival when first conceived or introduced to the public was intended not to go forward or that defendants intended not to perform by organizing the advertised amenities and accommodation.”The court also ruled that the complaint didn’t specify when statements promoting the event were made or allege they were false at the time.   “The Court agrees that the subjective qualifiers of ‘FOMO-inducing’ and ‘Coachella x1000’ are too ‘exaggerated, blustering, and boasting’ for a reasonable consumer to rely on,” the judge ruled, discussing Ja Rule’s tweets, which reference “fear of missing out” and the annual Coachella music festival. Fyre Festival creator Billy McFarland was sentenced to six years in prison last year for wire fraud charges. Ja Rule has denied accountability for the festival. Earlier this year, Netflix and Hulu released competing documentaries about the debacle.  Turo $90 at Daily Steals via Google Express Share your voice Turo: Save $30 on any car rental Preview • iPhone XS is the new $1,000 iPhone X See It Read DJI Osmo Action preview $210 at Best Buy Read the AirPods review See It Sarah Tew/CNET $299 at Amazon Recently updated to include digital-photo-frame capabilities, the Lenovo Smart Clock brings Google Assistant goodness to your nightstand. That makes for a mighty slow Windows experience. This Lenovo model features a 128GB solid-state drive, so it should be pretty quick to boot and load software, even with its basic processor. Minni faces police interrogation over Rifat murder

first_imgMinniPolice took Aysha Siddika Minni to the police superintendent’s office on Tuesday morning for interrogation over the murder of her husband Rifat Sharif in broad daylight, reports UNB.A team of police went to Minni’s residence near Barguna Police Lines around 9:45am and took her to the SP’s office, said witnesses. However, SP Maruf Hossain said police brought Minni to his office to take her deposition as a witness in the murder case.Md Humayun Kabir, inspector of Sadar police station and the investigation officer of the case, and the SP were taking her deposition under section 161 of the Code of Criminal Procedure for the sake of investigation, he said.Police also sought Minni’s cooperation to identify the murder suspects, according to the SP office. The new development came after Rifat’s father Dulal Sharif and locals demanded Minni’s arrest alleging that she had part to the gruesome murder of her husband. At a press conference at Barguna Press Club on Saturday night, Dulal Sharif demanded the arrest of his daughter-in-law to investigate whether she had colluded with the killers. He had alleged that Minni concealed the matter that she was previously married to Sabbir Ahmed alias Nayan Bond, the prime accused of the Rifat murder case who was killed in an alleged gunfight with police on 2 July, and she used to visit Nayan’s house frequently.Besides, instead of trying to protect Rifat on the day, she was busy with herself and even ‘helped the killers’, according to Dulal. He raised a 10-point allegation against Minni who has been made the first witness in the case.Besides, locals formed a human chain on the Barguna Press Club premises on Sunday morning to press for the same demand. Many people, including Rifat’s father Dulal Sharif, took part in the human-chain programme.Soon after the human chain, Minni arranged a press conference at her father’s house where she claimed that propaganda was being spread against her to protect the murderers. “My father-in-law (Dulal Sharif) is sick and he has no balance.”She alleged that a vested group has been out to implicate her in the case through misguiding her father-in-law so that the accused get released.About the claim that she had previously married to Nayan Bond, Minni refuted it, saying, “Why hadn’t Nayan stood in my way when I married Rifat if I had earlier married him?”Police have so far arrested 13 people in connection with the Rifat murder. Seven of them have confessed to their involvement in the murder.A video clip of the murder captured in a surveillance camera went viral on social media. It showed criminals hacking Rifat Sharif brutally in broad daylight in front of Barguna Govt College while his wife Minni was trying to save him.Rifat was sent to Sher-e-Bangla Medical College Hospital in Barishal where he died.Dulal Sharif, the father of Rifat, filed a case against 12 people.last_img read more

Tropical Rainstorm Harvey Impacts Yucatan Could Hit Texas By The End Of

first_img Share _____Copyright 2017 AccuWeather The tropical wave that was once tropical storm Harvey will push inland across the Yucatan Peninsula today, inundating the region with tropical moisture which will fuel heavy rainfall.Forecasters now say what could be Tropical Storm/Hurricane Harvey could make landfall somewhere from the Texas-Mexico border to central Texas coast sometime Friday. According to Weather Underground, “the current conditions should allow Harvey to regenerate into at least a tropical storm before it makes landfall on Friday, and it may be able to reach hurricane strength.” All of the models considered for Harvey’s landfall show that it will happen between the Mexico/Texas border and the central coast of Texas on Friday, weather experts add.  Regardless of development, coastal Texas can expect heavy rains in excess of five inches late this week.Meanwhile, the Harris County Office of Homeland Security and Emergency Management is monitoring the redevelopment of the tropical storm iand its potential impact on Texas coast.Heavy rainfall will also continue to impact parts of Belize and Guatemala. Rainfall totals will average between 2 and 4 inches and some locations could pick up greater than 6 inches. This will lead to mudslides and flash flooding in any higher terrain. Additionally, there can be gusty winds with the storm and can cause sporadic power outages.Tropical Rainstorm Harvey will reemerge into the Gulf of Mexico Wednesday morning into an environment of lower vertical wind shear, very warm sea surface temperatures and deep moist unstable air.Given these favorable conditions the low pressure area should intensify back into a tropical storm sometime Wednesday or Thursday. While the future movement of this system remains uncertain, most global computer forecasts are projecting the system to track northwest towards the northeast coast of Mexico. If the system does track in this manner, it could make landfall over northeast Mexico or perhaps deep South Texas on Friday.Residents and interests over eastern mainland Mexico and over South Texas should pay close attention to the future redevelopment and movement of this potentially high-impact storm system.Elsewhere in the Atlantic, we are monitoring a tropical wave over the eastern Bahamas. There remains a potential for this system to become better organized over the next few days.Very heavy rainfall and localized flooding can be expected across the Bahamas and Florida today through Thursday as the system slowly makes a turn to the north as a trough picks it up and sends it out to sea later this week. The last tropical wave is located east-northeast of the Leeward Islands. This system is unlikely to develop as it struggles with strong wind shear.last_img read more

Open Garden plants app for open network

first_imgThe technology offers an “automatic path choice.” When the network detects multiple Internet connections, it will select the fastest one available and will switch to another connection if the original slows or goes off line. This is being promoted as a mobile mesh network that can route data “opportunistically” through the right assets at the right time. The advantage is that it can offload traffic from an overburdened access route to one less utilized. The Open Garden founders built and patented their own discovery mechanisms so devices that run the software can easily detect each other. When asked about the implications of this advancement on battery power, the answer was that most of the power consumption comes from the data transmission. Open Garden instead can help the user save some battery by offloading to WiFi, which uses less power than a 3G or 4G connection. As the app is freely downloadable, the team was asked how they intended to make any money. The Open Garden team’s answer was by the freemium business model, historically commonplace with Open Source ventures, where revenues come in from special enterprise-level services for business customers, or sponsorships, or advertising. The team said they aim for a freemium model with extra features like VPN access for business users. Explore further (Phys.org) — The Open Garden network app, which was launched in private beta in February, is now available free for download. The San Francisco based startup, founded in 2010, is set to break down the in walls of connectivity — in seeking out Internet access or making do with spotty connections — that have become the status quo. The Open Garden team voices a general complaint that Operators behave as if broken networks are a fact of life. “Mobile networks are like closed gardens, separated by walls. If you own a smartphone from Carrier A and find yourself unable to surf the mobile web, you cannot use spectrum owned by Carrier B, or a nearby fixed line broadband connection owned by Carrier C.” Citation: Open Garden plants app for open network (2012, June 5) retrieved 18 August 2019 from https://phys.org/news/2012-06-garden-app-network.html More information: opengarden.com/ The Open Garden application interconnects devices, whether smartphones, laptops or tablets. to form a wireless peer-to-peer mesh network for access to the Internet. The team presented their case at the recent TechCrunch Disrupt conference. They answered questions from a conference panel about the capabilities, repercussions from industry, and business model for the startup.Cofounder and CEO Micha Benoliel told the audience that Open Garden is announcing the new app as “disruptive” because the application makes it so simple for a user to be connected. The mesh network allows Open Garden-enabled devices to automatically share Internet access and bandwidth. Essentially, you are riding on the Web access of other Open Garden app users, using peer-to-peer connections that form the network.center_img © 2012 Phys.Org Technology watchers reacting to the debut are supportive but tending to ask the same question: What will carriers do, if not openly revolt? The very idea of a crowdsourcing platform for mobile connectivity may not go down easily with carriers who may think this will hurt their business. The company says it may take time for carriers to accept the app as able to help their business. “The promise of hyperconnectivity will be fulfilled when the walls that separate the carriers’ closed garden finally open for the benefit of the industry and all users.” Benoliel has said that Open Garden already has an agreement with a “forward-looking” European carrier.Open Garden is available for Android, Windows, and Mac. The team plans for an iOS version in the future. On Monday, a reviewer said she was able to use Open Garden to surf the Internet on a smart phone using Firefox (Firefox is needed to browse with Open Garden if on an Android device, along with a browser add-on). Video streaming by way of another phone’s 4G connection, she said, looked a bit stilted but the quality was not bad. If you’ve ever received the dreaded temperature warning on your phone’s home screen after leaving it in a sizzling vehicle for too long, you know exactly what we’re talking about. And so does General Motors. The struggling American automaker knows your phone needs to cool out in the dog days of summer, too, just like you. If it doesn’t, if the temperature around your iPhone, Android or, fine, your BlackBerry, exceeds about 95 degrees, the high heat can shorten its battery life and potentially slow down its processor. Double bummer. Worse, permanent damage could occur and, in rare cases, the gadget you can’t live without could completely go kaput.Related: Proceed With Caution: Should Smartphones Come With a Warning?Terrifying, right? Well, GM, in a bid to “find new roads” and connect with tech-savvy younger drivers, doesn’t want any of the above to happen to your precious phone either. That’s why the 107-year-old company is adding a fancy new smartphone air-conditioning feature to some of its 2016 Chevy models, a modern move its hailing an “industry first.”Finally, your phone can chill out in its own, personal “Active Phone Cooling” cubby, basically a nook outfitted with a plastic a/c vent nozzle. That is if you get behind the wheel of a wireless-charging equipped 2016 Chevy Cruze, Impala, Malibu or Volt.GM says its engineers stumbled upon the idea while testing a smartphone wireless charging feature. “They noticed some smartphones would suspend charging or shut off all together after only a few minutes in high temperatures inside a car’s cabin,” a statement from the Detroit-based company reads. To combat the problem, they simply directed an air vent connected to the car’s a/c and ventilation system at the “charging bin where the phone rests.” And — easy, breezy — cooled air helps keep your phone from frying like an egg. Crisis averted…or so they say.Related: Texting and Driving?
